An image of your signature isn't a signed document
Kwalify gets documents signed on the phone. Each signer confirms with a one-time code, an audit trail records who signed and when, the signed document is sealed as a PDF, and anyone can check it on a verify page. It's a standard electronic signature under the ECTA.

Draw, type or upload your signature
There are three ways to make your signature with this free signature maker. Use whichever looks most like you.
- Draw it with your finger, a mouse or a stylus. The line thins when you move quickly and thickens when you slow down, like ink from a pen. Choose black or blue, and a thin, medium or thick pen.
- Type your name and tap one of five handwriting styles. It's the quickest way to a neat signature, and it works with a keyboard alone.
- Upload a photo of your signature on white paper. The tool removes the paper, crops to the ink and can turn the ink black or blue. The photo stays on your device.
Then download a transparent PNG at twice the screen size, so it stays sharp in Word and PDFs, or copy it and paste it straight into your document. Tick Also make my initials for a matching PNG of your initials, for documents you initial on every page.
Is a signature image a legal signature?
In South Africa the Electronic Communications and Transactions Act 25 of 2002 (ECTA) sets out when an electronic signature meets a requirement for a signature. What it says depends on who requires the signature.
- Being electronic doesn't take away its force. The Act says "an electronic signature is not without legal force and effect merely on the grounds that it is in electronic form" (section 13(2)).
- When the parties require a signature. Where the parties require an electronic signature but haven't agreed on the type, the requirement is met if the method identifies the person and shows their approval, and was as reliable as was appropriate for the purpose (section 13(3)). An image pasted into a file doesn't by itself show who put it there, or when.
- When a law requires a signature. Where a law requires a person's signature and doesn't say which type, an electronic document meets that requirement only with an advanced electronic signature (section 13(1)). An advanced electronic signature is one that results from a process accredited by the Accreditation Authority under section 37 (section 1, section 37). The images this tool makes don't come from an accredited process.
- Some transactions are left out. The ECTA does not make any of the transactions in Schedule 2 valid: an agreement to sell land or other immovable property, a lease of land for more than 20 years, a will or codicil, or a bill of exchange (section 4(4) and Schedule 2). The Act doesn't say what they need instead. Check with an attorney before signing one of those electronically.
For documents you may need to rely on later, keep a record of who signed and when, and that nothing changed afterwards. If you're unsure whether a signature image is enough for a particular document, check with an attorney.
